Boehner abandons fiscal cliff plan as Republicans balk

WASHINGTON (Reuters) - Republican lawmakers delivered a stinging rebuke to their leader, House of Representatives Speaker John Boehner, on Thursday when they failed to back an effort designed to extract concessions from President Barack Obama in year-end "fiscal cliff" talks.

The dramatic twist threw into disarray attempts to head off $600 billion worth of indiscriminate tax hikes and spending cuts that could push the U.S. economy into recession next year.

It also cast doubt over Boehner's future as speaker after failing to control unruly conservatives in his caucus.

With only 11 days left for bickering politicians to prevent automatic tax hikes and spending cuts, U.S. stock futures fell sharply on the news of the rebuke to Boehner.

The Ohio congressman had hoped to demonstrate Republican unity by passing a bill through the House, known as "Plan B," that would limit income-tax increases to the wealthiest sliver of the population - those earning $1 million and more, a far smaller slice of taxpayers than Obama wants to pay higher taxes.

But Boehner canceled the vote after failing to round up enough support from his party because many conservative Republicans are opposed to tax hikes on even the richest wage-earning Americans.

"The House did not take up the tax measure today because it did not have sufficient support from our members to pass," Boehner said in a statement after huddling with other Republican leaders.

The White House pledged to work with Congress to reach a deal as quickly as possible.

"We are hopeful that we will be able to find a bipartisan solution quickly that protects the middle class and our economy," White House spokesman Jay Carney said in a statement.

The bill, had it passed, would have put Republicans on record as supporting a tax increase on those who earn more than $1 million per year, breaking with decades of orthodoxy. It won the blessing of influential anti-tax activist Grover Norquist, but other conservative groups fiercely opposed it and many rank-and-file members said they would not support it.

Obama wants to raise taxes on families earning more than $400,000, a much lower threshold.

RECESSION THREAT

Obama and Boehner aim to reach a deal before the New Year, when taxes will automatically rise for nearly all Americans and the government will have to scale back spending on domestic and military programs. Economists say the combined $600 billion hit to the economy could push the U.S. economy into recession.

Boehner said Obama now must first pass a bill through the Democratic-controlled Senate before he holds another vote in the House.

Democrats said Boehner should first hammer out a deal with Obama. "The only way to avoid the cliff altogether is for Speaker Boehner to return to negotiations," said Adam Jentleson, a spokesman for Senate Democratic Leader Harry Reid.

With Republicans in chaos, Boehner will almost certainly need support from House Democrats to pass a deal before the end of the year. But he will have to keep an eye on his right flank before he stands for re-election as the top House lawmaker on January 3.

Alternatively, Boehner could wait until the new year to hold a vote. At that point, tax cuts passed in 2001 and 2003 will have expired for all Americans, and it presumably would be easier to pass a bill that would restore tax cuts for most.

Opinion polls show that more Americans would blame Republicans rather than Obama if they don't reach a deal before then.

So far, negotiations appear to be following the dysfunctional pattern set by the 2011 battle over the debt ceiling: fitful progress alternating with public posturing. Boehner also struggled during that showdown to corral the most conservative members of his own party.

Washington narrowly avoided defaulting on the U.S. government's debt in August 2011, but the down-to-the-wire nature of the effort prompted a first-ever debt rating downgrade and spooked investors and consumers.

This time around, concern over the fiscal cliff has weighed on markets but analysts say that investors appear to be assuming that the two sides will avert disaster.

"The markets are likely to interpret this as signaling even tougher negotiations in coming days," Mohamed El-Erian, chief executive of bond giant PIMCO, told Reuters.

S&P 500 stock futures fell 1.6 percent while Dow Jones stock futures and Nasdaq futures both lost 1.5 percent. At one point S&P 500 e-mini futures were down as much as 3.6 percent.

Lawmakers had hoped to wrap up work before the year-end Christmas break, but leaders in both the House and the Senate have indicated that they may call members back to work next week.

"The brinkmanship will continue," said a senior Republican aide. "This isn't the end of the story. More drama to come."

Forrester report finds US tablet ownership doubled this year

Forrester Research has come out with its annual report on technology consumption in the US, and tablets are certainly gaining popularity. Although slightly lower than Pew Research's figures, Forrester deduced from its nigh 60,000-strong survey that 19 percent of 'mericans over the age of 18 own at least one tablet -- double the number the research outfit noted last year. While tech penetration is lowest among adults aged 47 and up, 14 percent of this demographic now have slates, which again is twice the figure recorded in 2011. Another notable stat that's risen is daily internet use, with 84 percent of adults hopping online every day (up from 78 percent last year), and approximately half of those owning a smartphone of some variety. TVs are pretty well connected also, as 43 percent of the plugged-in population has accessed the net from their living rooms, with games consoles being by far the most popular intermediary. The whole report isn't available to the public, but why not use the time you would've spent reading it inspecting what's under the tree, and hoping you'll be responsible for upping those tablet stats in next year's report.

As a brand, Acer doesn't quite yet resonate in the mobile space. After all, it took the company the better part of a year to release the CloudMobile. But from the looks of these (very clear) leaks captured on Chinese site VR-Zone, it seems Acer may be prepping a mid-range device for that market. Allegedly dubbed the V360, the handset appears to be running Android 4.1.1 Jelly Bean which, if true, would be a first for the OEM. It's not clear if the UI is skinned, but if its previous work on the CloudMobile's UX is any indication, expect this one to be very lightly skinned. Apart from that, there are a handful of unverified specs floating about, like a 4.5-inch qHD display, unknown dual-core processor clocked at 1GHz, five-megapixel camera and DTS sound (as indicated by backplate branding). As for the possible release and pricing for this mystery device, well, that's very much up in the air. Acer would first have to confirm its existence before we move on to those market realities.

Final NBC team member in Syria?leaves safely

The final member of the NBC News team working with Chief Foreign Correspondent Richard Engel crossed safely from Syria into Turkey early Wednesday, NBC News said in a statement.

Ian Rivers, who provides technical support for NBC News,?got separated from the rest of Engel's production team in the midst of the firefight early Monday, which resulted in the team's escape from captivity. Until now, Rivers' whereabouts in Syria had been unknown. Rivers was said to be in good condition and will be evaluated in Turkey, according to the network.

?Now that Ian Rivers has been reunited with Richard Engel?s entire production team, all of us at NBC News can breathe a huge sigh of relief and express our deep appreciation to all who helped secure their freedom. At the same time, our thoughts and concerns are with those who remain missing inside Syria and we hope for their swift and safe release,? said NBC News President Steve Capus.

Engel, 39, and his team disappeared shortly after crossing into northwest Syria from Turkey last Thursday. The network had not been able to contact them until learning that they had been freed on Monday.

The network said there was no claim of responsibility, no contact with the captors and no request for ransom during the time the crew was missing.

After entering Syria, Engel and his team were abducted, tossed into the back of a truck before being transported to an unknown location believed to be near the small town of Ma'arrat Misrin. During their captivity, they were blindfolded and bound, but otherwise not physically harmed, the network said.

Early Monday evening local time, the prisoners were being moved to a new location in a vehicle when their captors ran into a checkpoint manned by members of the Ahrar al-Sham brigade, a Syrian rebel group. There was a confrontation and a firefight ensued. Two of the captors were killed, while an unknown number of others escaped, the network said.

Engel and his team were unharmed in the incident. Engel and several other members of the team remained in Syria until Tuesday morning when they made their way to the border and re-entered Turkey, the network said.

After being held captive for five days in Syria, NBC's Richard Engel and his team recount being ambushed and blindfolded before being freed at a checkpoint.?

Trustonic: a way for mobile apps to benefit from ARM's hardware-level security

This here narrative begins back in April, when ARM, Giesecke & Devrient and Gemalto teamed up and gave themselves precisely nine months in which to find the perfect brand name for their newly merged mobile security platform. Today, we're looking at the fruits of their efforts: Trustonic; a word which snappily captures the essence of what's at stake (trust-onic) and which you may soon encounter in connection with your next-gen smartphone, Mastercard payment app or 20th Century Fox DRM'd media.

What does Trustonic do, exactly? Pretty much what Mobicore already does in the Galaxy S III, or what Trusted Foundation does inside a Tegra-powered tablet: it allows certain pieces of software to tap into hardware-level encryption and authentication, courtesy of the TrustZone silicon that many ARM chips already contain, thereby removing many of the risks associated with malware and other intrusions within the mobile OS. As far as we understand it, the key difference with Trustonic is that it won't require direct input from OEMs like Samsung and NVIDIA, but will instead be more readily accessible to any banking, payment or DRM service that is willing to pay for a key. In return, the service would get enhanced security and faster logins for its users, who'd only need to enter a short, locally-verified PIN rather than wading through cloud-based steps to prove their identity. Indeed, perhaps that's where the tonic comes into it.

(AP) ? Helena Bonham Carter apparently shares more with Victor Hugo than just a role in the film based on his novel.

A study by genealogy website Ancestry.com reveals Victor Hugo was a political colleague of a cousin of the 46-year-old actress. Carter stars as Madame Thenardier in the upcoming musical "Les Miserables." The film is an adaptation of the stage musical based on Hugo's 1862 book.

Ancestry.com says French financier and politician Achille Fould was Carter's first cousin five times removed. He served with Hugo in the post-revolutionary French government in the 1840s. Fould was minister of finance; Hugo was in the constitutional and legislative assembly.

Fould was a staunch supporter of Louis Napoleon III when he seized power of the French empire in 1851, while Hugo declared him a traitor.

Carter's ancestor moved up in power and authority in the new regime. Hugo left the country and wrote scathing letters and poetry about the treachery of his former colleagues, including Fould. In one publication, Hugo called Fould a "chameleon" with "blood on his hands." It was during this time that Hugo wrote "Les Miserables."

S.C. Johnson's Waxdale facility running 100% on clean energy

S.C. Johnson installed three mini wind turbines on the roof of its headquarters in Racine earlier this year.

S.C. Johnson & Son Inc.?s largest global manufacturing facility will now run virtually 100 percent on clean energy with the installation of two wind turbines at the Mount Pleasant site, the company said Tuesday.

The two turbines started spinning Tuesday and will produce about 8 million kilowatt hours of electricity annually at the company?s Waxdale manufacturing facility, enough to power 700 homes for a year, the company said.

The combination of the wind turbines and two cogeneration turbines that have been in place since the mid-2000s will allow the facility to produce an average of 100 percent of its electrical energy on-site. The cogeneration systems use waste methane gas from a nearby public landfill and clean-burning natural gas to generate 85 percent of the facility?s electrical energy, the company said.

The 415-foot-tall wind turbines, with their 135-foot-long blades, will help reduce carbon emissions associated with powering the facility by 6,000 metric tons annually. The company said it?s the largest on-site, company-owned wind turbine manufacturing project in the Midwest.

The Racine-based consumer products company?s Waxdale facility makes brand products including Scrubbing Bubbles, Glade and Windex.

Grief is a process that most people have experienced in their lives. It is an interesting fact that even though many of us have gone through it before we seem to forget how it was for us and lack knowledge on how to be with people who are in it.

Experiences with clients have shown that there are really only a few simple guidelines to follow to support people who are grieving. The grief cycle, which was put forward by Dr. Elisabeth K?bler-Ross, contains the stages of denial, anger, bargaining, depression and acceptance. Depending on where the person in grief is there might be slightly different approaches needed. The best way to find out which of the following suggestions would work, is to ask them.

Being there with them

As simple as it may sound, being there with the grieving person is the first and most important suggestions. It is true that sometimes time alone is needed or desired but more often than not, grieving people are left alone for too long, when in fact they need companionship. This might mean staying with them watching television or having a meal, asking them to join you to go out or just checking whether they wish you to come over and keep them company.

Asking them: How are you doing?

This question is often avoided for various reasons, either because the questioner is uncomfortable with their own unresolved grief that might surface or with the potential reaction of the person in grief. Sometimes days or weeks pass without them ever being asked by people who care for them. Dare to ask. There is no need to change the situation or trying to make them feel better ? simply listen and show them you care.

Wanting them to feel better and get over it

Grief is a process that can take 2 hours, 2 days, 2 weeks, 2 months, 2 years or 20 years. There is no set time limit when people should be over it. Whether they are grieving for a loss that just occurred or for old unresolved hurt ? all is possible and has its place. Your job as a support person is to allow them to be where they are at and not moving them into a stage they are not.

Elisabeth K?bler-Ross proposed the grief cycle and its stages as being sequential. In my experience the stages can appear without any seeming order and be repeated if needed. I see the grief cycle as a spiral on top of a cake and the 5 slices of the cake representing the stages. As we travel along the spiral from the center towards the outer side of the cake we can revisit the stages (different slices) multiple times. Often the experience of ?I?m feel the same way as before, nothing has changed yet? is a sign that the client is revisiting a stage however they are no longer in the center but have travelled further outside.

SAP co-founder sells shares worth more than $155 million

FRANKFURT (Reuters) - SAP's co-founder Hasso Plattner sold shares in the German business software maker worth 120 million euros ($155.74 million), divesting a portion of his overall stake, the company said on Friday.

To protect the stock price, a bank will place 10 million euros worth of the shares every month until no more are left.

"The sale will be carried out at the bank's own discretion in the stock market or over the counter, for the first time in November 2012 and then again in the months January through November 2013," SAP said in a regulatory statement.

SAP shares reversed their gains, trading down 0.5 percent at 59.91 euros by 10:54 a.m. EDT.

Plattner is SAP's largest shareholder with 121.49 million shares, representing a 9.89 percent stake, according to Thomson Reuters data from the end of September. Based on the current share price the stake is worth a little over 7 billion euros.

With a 73 billion euro market capitalization, SAP is the most valuable company in the German blue chip index, followed by Siemens, worth a little under 70 billion.

Retinal implant could let visually impaired 'see' Braille

An "artificial eye" is still a long ways off, but researchers have made the low-resolution devices now available useful in a new way.?Instead of trying to replace vision entirely, they only "translate" text, presenting it to the user in a more familiar format: Braille.

Today's retinal implants are promising and allow people suffering from certain kinds of visual disability to see very rough shapes and contrasts. But with a resolution of only a few hundred total pixels, they are unable to display the world in anything but the lowest fidelity.

But replicating vision isn't just about the view. Sighted people take the ability to read things like?street signs and menus for granted, but not only is this difficult or impossible for most visually-impaired?people, there are relatively few accommodations available, as there are for things like crossing the street or using an ATM.

With this in mind, the team at Second Sight decided to modify?an Argus II retinal implant system, in which visual signals are presented to the retina in the form of electrical signals. They hooked the built-in camera up to software that translates text it sees into Braille, and then sent that signal on to be displayed by the implanted electrode arrays.

Low resolution isn't a problem for Braille, since letters are represented as dots in a three-by-two grid rather than using the lines and curves of standard glyphography. In testing, they would show up to four letters at a time ? not efficient for reading longer sentences, but?enough to quickly differentiate between "left" and "right," "open" and "closed," or "men" and "women."

Their test subject?had limited success with the system: Already a user of Braille and the Argus II implant, he was able to identify letters correctly 89 percent of the time. But as the length of the word grew, success rate fell.

Still, any improvement over the previous system, in which the highly pixelated image could barely show letters or words at all, would surely be welcome to users of the implant. While for reading books and articles, Braille is much faster, that option doesn't exist for many signs and other pieces of writing.

At the moment, retinal implants are still something of a rarity; while hundreds of thousands could potentially benefit from the technology, they are still in a relatively early stage of development and have not yet entered widespread clinical testing. But whenever they start to be prescribed to the general population, having helpful alternative modes like this one could be very important to the people for whom they are intended.

The paper describing the research, "Reading visual braille with a retinal prosthesis," appeared recently?in "Frontiers in Neuroprosthetics." The lead author is?Thomas Lauritzen of Second Sight, in collaboration with colleagues from?Brigham Young University and two French vision research institutes.

Gold medalist Oksana Baiul sues talent agency

(AP) ? Olympic gold medalist Oksana Baiul (by-YOOL') is suing a talent agency claiming it mismanaged money she earned after her gold medal-winning figure skating performance in 1994.

The lawsuit filed in Los Angeles claims she signed contracts with the William Morris Agency shortly after her victory but only recently discovered that hundreds of thousands of dollars had gone uncollected or were improperly spent.

The lawsuit claims the Ukrainian-born skater signed the agreements without being able to read, write or understand English. She claims the agency failed to properly explain agreements to her and misrepresented the amounts she is owed.

The agency, now known as William Morris Endeavor, declined comment.

Baiul now lives in Pennsylvania and is seeking more than $1 million, although the exact amount owed would be determined by jurors.

Blue Jays hire John Gibbons as manager again

TORONTO (AP) ? John Gibbons was hired as manager of the Toronto Blue Jays for the second time Tuesday, returning to a team that just invigorated its roster after a blockbuster trade with the Miami Marlins.

"I never would have guessed this could happen," he said at a news conference.

Gibbons managed Toronto 2004-08 and had a 305-305 record, making him the third-winningest manager in franchise history.

He succeeds John Farrell, who spurned Toronto for his dream managing job in Boston. Gibbons, however, takes over a very different team from the one Farrell managed.

The surprise announcement came a day after the Blue Jays completed a mega deal in which they acquired All-Star shortstop Jose Reyes and pitchers Josh Johnson and Mark Buehrle from Miami. Toronto agreed to the trade last week and Commissioner Bud Selig approved it Monday. The Blue Jays, extraordinarily busy in this offseason, also finalized a $16 million, two-year deal with free agent outfielder Melky Cabrera.

"Who wouldn't want to be here?" Gibbons said. "The front office has put together a legitimate contending type team."

Toronto general manager Alex Anthopoulos had said he wanted someone who was familiar with the organization and city. Anthopoulos was an assistant GM when Gibbons managed Toronto. Gibbons joins Cito Gaston as managers serving two stints with the Blue Jays.

"I don't know that there was anybody better in terms of managing a bullpen, connecting with the players, connecting with the front office, holding players accountable," Anthopoulos said.

His best season was in 2006, when Toronto went 87-75 to finish second in the division ? the same season he had a well-publicized blowup with players Shea Hillenbrand Ted Lilly. Gibbons said he regrets the physical altercation with Hillenbrand and called it a black eye, but Anthopoulos defended him and said if you can't play for Gibbons then you can't play for too many guys.

Gibbons most recently managed the San Antonio Missions of the Texas League (Double-A) in the San Diego Padres' organization last season. He also had three seasons as the Kansas City Royals' bench coach.

Gibbons joined the Blue Jays' coaching staff in 2002 as a bullpen catcher and was promoted midseason to first base coach. He served in that capacity until replacing Carlos Tosca in 2004. Before joining the Blue Jays the first time, Gibbons spent 11 seasons working with the New York Mets.

Blue Jays President Paul Beeston said he was equally surprised when the Marlins trade became a possibility and when Anthopoulos told him he was interested in hiring Gibbons. "They were back to back shockers," Beeston said with a laugh.

"I said 'Are you serious'," Beeston said of Gibbons. "Forget about him being an intellectual, he's a baseball guy. And those are the guys you really want in your organization."

Beeston said the Marlins trade makes the Blue Jays contenders in the AL East. They haven't reached the playoffs since winning their second consecutive World Series in 1993. Only Kansas and Pittsburgh have longer playoff droughts.

Beeston said the payroll currently is about $120 million. Anthopoulos said the Blue Jays have gone beyond what they thought the payroll could be, but said he was promised that if the right opportunity came along ownership would spend.

Anthopoulos first targeted Johnson and but quickly learned Reyes and Buehrle were also available. He told Beeston he knew it was a lot of money, but said Beeston encouraged him and checked with the owners, Rogers Communications.

"I always felt when the opportunity was right that Rogers would invest in the ballclub," Beeston said. "We've spent the money now let's go out and win."

NCAA cross country: Badgers seniors justify coach's decision to go for broke

LOUISVILLE, Ky. ? A season that began with a series of question marks for the University of Wisconsin men?s cross country team ended with a collective exclamation point for three seniors on the squad.

Just a month removed from being in limbo as to whether they would even run this year, Mohammed Ahmed and Reed Connor joined classmate Maverick Darling in racing to All-America honors and carrying the Badgers to a runner-up finish at the NCAA championships on Saturday at E.P. ?Tom? Sawyer State Park.

The finish marks the third straight top-three finish for the class, which led UW to its fifth national title last season. Ahmed and Darling also competed at the NCAA meet in 2009, when the Badgers finished seventh.

?For having as many question marks as we did early in the season, I can?t be happier with my guys,? Darling said. ?We take pride in this.?

Darling, a fifth-year senior, knew this season would be his last in a Badgers uniform. But returning All-Americans Ahmed and Connor didn?t join him in the UW starting box until the Big Ten Conference meet, as coach Mick Byrne was weighing whether to redshirt the duo and bring them back for a run at a title next year.

Byrne knew he?d have a dynamite front three, but he was waiting to see how the back end of the team developed during workouts.

?It was close, I think, but guys started showing up. Rob Finnerty, Alex Brill, Alex Hatz, Michael Van Voorhis, those guys started showing up,? Ahmed said. ?We thought we could win it, and look how close it was.?

Connor said the decision to go all in for 2012 wasn?t really all that hard, for one simple reason.

?We kind of knew that we were going to go after it, because ? Maverick,? Connor said. ?If Maverick could have redshirted, yeah, we might have said, ?All right, we?ll wait a year and give Hatz and Brill and some guys time to develop.??

Byrne finally decided to turn Ahmed and Connor loose before the Big Ten meet, and the Badgers responded by winning their 14th consecutive title. They followed that up by winning an 11th straight NCAA Great Lakes regional crown before finishing second to Oklahoma State in the national meet on Saturday.

Ahmed, Darling and Connor ran a good portion of the race together, and finished eighth, 11th and 12th, with just a 7?-second spread between them.

?To finish together like that, you can?t put it into words,? Darling said. We?ve been through so much together; we?ve done so much together. Various backgrounds, obviously. To have that bond that we have, and the brothership, whatever you call it, it?s just phenomenal.?

While the decision paid dividends for this year?s squad, it leaves next year?s team without a returning All-American. It will be the first Badgers team without once since the 2000 squad.

Despite that, Byrne was adamant that the decision was the right one.

?Absolutely,? Byrne said. ?Big Ten title, Great Lakes title, and now finishing second at the NCAA ? absolutely, it was the right decision for the program. We?ll worry about next year next year.?

We all know -- and hopefully accept -- that with any new version release of Android, there's bound to be a few little bugs hidden within. While Google will test, test and test again, there's always likely to be something that slips the net, many of which most users never come across. What we find in Android 4.2 however, definitely belongs on some kind of blooper reel. They forgot December. 

Google Calendar is unaffected, so we're all good on that front. But, when adding events to profiles within your People application, there is no option to add dates in December. Loved ones birthdays, Christmas, New Years Eve, all don't exist, at least in this part of Android 4.2 anyway. We've still got a Nexus 7 lying around with Android 4.1.2 on it, and indeed over there all is well. 

If nothing else, it's pretty embarrassing. The issue has been reported to the Android bug tracker, and we can imagine that a fix will be rolled out in the not too distant future.

Company vows continued search near burned Gulf rig

NEW ORLEANS (AP) ? The company that owns an oil platform that caught fire in the Gulf of Mexico has vowed to continue searching for a second missing worker after a body was recovered in the waters near the site.

The remains of the unidentified person were found Saturday night by divers hired by Houston-based Black Elk Energy, Coast Guard spokesman Carlos Vega said. Vega said the Coast Guard would be turning over the remains to local authorities. The Coast Guard has suspended its own search.

John Hoffman, the president and CEO of Black Elk Energy, wrote in an email late Saturday that the body is apparently one of two crew members missing since an explosion and fire on the oil platform Friday morning. Hoffman said the body was found by a contract dive vessel.

"Divers will continue to search for the second missing worker," Hoffman wrote in an email. "Our thoughts and prayers are with the families."

Hoffman said the body was found close to the leg of the platform, near where the explosion occurred, in about 30 feet of water. He said the missing men were employees of oilfield contractor Grand Isle Shipyard.

GIS CEO Mark Pregeant released a statement that the company has notified the family of those involved but was declining to release their names, according to WWL-TV in New Orleans.

The Coast Guard had suspended its own search earlier Saturday after 32 hours spent covering 1,400 square miles near the oil platform, located about 20 miles southeast of Grand Isle, La.

"We saw no signs of life. We have suspended the search... pending further development," Vega said.

Authorities have said the blaze erupted Friday morning while workers were using a torch to cut an oil line on the platform.

Pregeant's statement, however, said the cause of the fire and explosion is unknown and that "initial reports that a welding torch was being used at the time of the incident or that an incorrect line was cut are completely inaccurate."

Four other workers who were severely burned remained hospitalized Saturday night. Officials at Baton Rouge General Medical Center said two men were in critical condition Saturday, while two men were in serious condition. The four, being treated in a burn unit, are also employees of Grand Isle Shipyard and are from the Philippines.

After Friday's blaze, 11 people were taken by helicopter to area hospitals or for treatment on shore by emergency medical workers.

Grand Isle Shipyard employed 14 of the 22 workers on the platform at the time of the explosion, WWL-TV reported. A man who answered the phone at the company's Galliano, La., office on Saturday said no one was available to comment.

Separate from the explosion, Grand Isle Shipyard is facing a lawsuit by a group of former workers from the Philippines who claim they were confined to cramped living quarters and forced to work long hours for substandard pay. The lawsuit was filed in late 2011 in a Louisiana federal court and is pending. Lawyers for the company have said the workers' claims are false and should be dismissed.

Meanwhile, company officials said no oil was leaking from the charred platform, a relief for Gulf Coast residents still weary two years after the BP oil spill illustrated the risk that offshore drilling poses to the region's ecosystem and economy.

Black Elk released a statement saying that the platform wasn't operating and hadn't been since August.

Black Elk Energy is an independent oil and gas company. The company's website says it holds interests in properties in Texas and Louisiana waters, including 854 wells on 155 platforms.

New Mexico Interstate Stream Commission responds to Pecos River irrigation claims

The New Mexico Interstate Stream Commission says it is examining all claims of water level declines that area well owners attribute to the ISC's augmentation pumping at the Seven Rivers well field.

On Thursday, ISC staff began conducting field interviews in Lakewood and surrounding areas to examine all dry wells allegedly impaired by the ISC's pumping at Seven Rivers. The interviews will continue today.

"The ISC is taking these allegations very seriously," said Lela Hunt, ISC public information officer, in an email response to the Current-Argus' request for comment on the situation.

Hunt said the ISC was first contacted this past September by a well owner in Lakewood, advising that her well, which is between 10 and 12 miles from the Seven Rivers Well Field, had gone dry, and the ISC staff immediately responded. They provided the documentation the well owner requested and provided supplemental information about the 2003 Pecos Settlement and ISC's augmentation pumping obligations at the Seven Rivers well field in subsequent emails.

"In addition to working one-on-one with this particular well owner, on Oct. 17, ISC and the New Mexico Office of the State Engineer staff attended a public meeting in Lakewood, together with area well owners and state legislators and local political representatives," Hunt said, adding that ISC staff listened to the complaints of various well owners and addressed them in both a question and answer segment and in one-on-one

discussions with many well owners. Hunt said since the October meeting, the ISC has received additional claims of impairment. Of the almost two dozen allegedly affected wells, some are more than 20 miles away from the Seven Rivers well field and many are in a different aquifer from that in which the ISC is pumping.

"Moreover," Hunt notes, "Augmentation pumping by the ISC under the Pecos Settlement amounts to only 3 percent of all Pecos pumping in the Lower Pecos River Basin."

She said although the ISC will continue to investigate water level declines in the Lakewood area, the Pecos Basin is experiencing record drought. "Aquifer recharge is suffering and surface water supplies are extraordinarily low," she said. "For instance, the Pecos River flows have been at record lows, with the river drying at Artesia this year for the first time since 1964.

"Brantley Reservoir is at record low levels and the Carlsbad Irrigation District (CID) was able to make only one small block-release this year, as opposed to the three releases it typically makes in normal years. The past 24 months have been the hottest and driest on record in New Mexico."

ISC officials also say drought conditions are placing pressure on the implementation of the 2003 Pecos Settlement, an agreement between New Mexico, CID, Pecos Valley Artesian Conservancy District and the United States Bureau of Reclamation. All of the parties to the Settlement, including the ISC, are bound by its terms. "The Settlement followed New Mexico's bruising loss to Texas in 1988 in the United States Su-preme Court for violations of the Pecos River Compact," Hunt explained. "The Pecos Settlement was executed and implemented to protect water right owners throughout the Pecos Basin by preventing priority calls and the unilateral administration of the Pecos Basin by the federal gov-ernment by ensuring New Mexico's compliance with the compact."

She said currently, the drought is making it impossible for the ISC to pump a quantity of water to satisfy the "targets" set forth in the Settlement. The ISC and the other parties to the Settlement are discussing the issue and its implications for the ongoing implementation of the agreement, she said. The Settlement Agreement also requires that the ISC provide additional water to the CID, the senior water right owner on the river, through augmentation pumping at Seven Rivers.

Farming, and the water provided to irrigators within CID, is a significant component of the Carlsbad area's economy. Since the ISC began Settlement pumping in March 2011, all pumping has been for the benefit of CID; no pumping has occurred to satisfy Compact deliveries to Texas, Hunt said.
